DEFINITIONS and TERMS

Mentioned in the İşbu GDPR Clarification Text;

Personal Data : Refers to all kinds of information about an identified or identifiable real person. In the justification, the fact that a person is specific or identifiable is defined as making that person identifiable by associating existing data with a real person in any way. (Name, Lastname, ID Number, Passport Number, Home Address, Phone number, Entry and Exit Times to the System, Areas/products they visit and transactions they make, Digital data stored in databases or files related to their locations, Documents such as job applications/resumes, order records, Place/ Date of Birth, Vehicle License Plate, E-Mail Address / IP Address, Fingerprints, Video and Audio Recordings, All similar data that make the person identifiable)

Special Nature :Personal data of a special nature are data that may cause discrimination or victimization about the person concerned if they are found out. Therefore, they need to be protected much more strictly than other personal data. Personal data of a special nature may be processed with the explicit consent of the relevant person or in limited cases specified in the Law. (Race, Ethnicity, Political Opinion, Philosophical Belief, Religion, Sect or other beliefs, Disguise And Clothing, Association, Foundation or Trade Union Membership, Health, Sex Life, Criminal Conviction/Property Data, Data Related to Security Measures, Biometric and Genetic Data)

Processing of personal data: All kinds of transactions performed on personal data, including the acquisition, recording, storage, modification, sharing with third parties and transfer abroad of personal data by automatic means or by non-automatic means provided that the personal data is part of any data recording system,

General Data Protection Regulation No. 6698 “GDPR”: The Law which entered into force through publication in the Resmi Gazete on April 7, 2016.

Consent : Consent given on a specific subject, based on information and free will, in a clarity that will leave no room for hesitation, limited only to that transaction.

Anonymization: This is the making of personal data that cannot be associated with an identifiable or identifiable real person under any circumstances, even by matching it with other data.

Personal Data Owner (Contact Person): A person whose personal data is processed, for example; Customers, suppliers, visitors, retailer/service employees, employees of official institutions, employees and employee candidates.

Data Processor:A natural or legal person who processes Personal Data on behalf of the data controller based on the authority granted by the data controller,

Data Controller: The natural or legal person who determines the purposes and means of processing personal Data and is responsible for the establishment and management of the data recording system. It is the person who determines the “why” and “how” the data processing activity is performed in a general sense.

Contact Person: The person who provides communication with the institution and communication with the Data Owners. The contact person is not the representative of the Data Controller. The contact person is the person who does not have the authority to make transactions on behalf of the Data controller and to whom future requests from the Institution are communicated. (There is no evaluation authority for questions and requests from Data Owners, and only the contact provider is in the position.)

Regarding GDPR, Cases Where UNNA BİLİŞİM SAN.TİC.A.Ş. May Process Your data Without Your Consent

Regarding the 5th article of GDPR, in the following cases, according to the law above, UNNA BİLİŞİM SAN.TİC.A.Ş. may process your personal data without your consent:

• In cases where it is clearly stipulated in the laws,
• If you are unable to disclose your consent as a data owner due to actual impossibility, or if your consent is not legally valid, it is mandatory to process your personal data in order to protect the life or physical integrity of yourself or someone else in cases where your consent is not recognized as legally valid,

• For when your personal data has been made public by you,
• The case where data processing is mandatory for the establishment, use or protection of a right,
• Provided that it does not harm your fundamental rights and freedoms that you have,data processing is mandatory for UNNA BİLİŞİM SAN.TİC.A.Ş.‘s legitimate interests.

The relevant legal regulations in force will be applied primarily in the processes related to the Collection, Processing, Transfer, Storage and Destruction of Personal Data within the scope of the Clarification Text. In the event of a discrepancy between the applicable legislation and the Disclosure Text, the Data Controller accepts that the applicable legislation will find an area of application.

KVKK Clarification Text has entered into force on 01.01.2023, on our internet site https://www.unna.com.tr , it is published under the Documentation of Management Systems in the common area on the server and it is presented to the access of our employees and all related parties by hand. In order to adapt to the changing conditions and legislation, the publication date will be updated and re-announced if the entire or certain articles of the Clarification Text are updated.
